This Mental Performance Coaching Informed Consent Agreement and Statement of Work (this “Agreement”) is made between Momentum Labs, LLC (“we,” “us” or “Momentum Labs”) and the undersigned client (“you,” “your” or “Client”). Please read the following information about our coaching practice, the services you will receive, and your obligations carefully and please ask us any questions you may have. We look forward to working with you.
Our Site and Services are intended for use by individuals aged 13 and older. We do not knowingly collect personal information from children under the age of 13. If we become aware that a child under age 13 has provided personal information to us without verified parental consent, we will delete such information as soon as practicable.
Coaching is designed to help you make progress toward your goals. You should expect that coaching will involve asking you questions, collaboratively designing goals, providing you with information and skills, and giving you feedback. You and your values live at the center of the coaching process.
Importantly, coaching is not the same as therapy. The services provided by Momentum Labs are strictly professional mental performance coaching and are neither clinical in nature nor intended to be a substitute for medical or psychological treatment. These services are designed to support your personal development, goal achievement and mental performance. While coaching is effective for most people, it may not address all your needs and there may be times when a referral to a therapist providing mental health services is appropriate. Ultimately, you and/or your parent/guardian accept responsibility for both your actions and your decisions. If you request assistance, Momentum Labs can aid in providing referrals for licensed mental health services.
Participation in coaching is voluntary. You understand that you may choose to discontinue services with Momentum Labs at any time without penalty, provided that any outstanding fees for services rendered up to that point are paid in accordance with the terms of this Agreement.
The information you share during coaching will remain confidential unless you give Momentum Labs specific permission to release the information, except as provided below or if we are required by law to release it. By signing this Agreement, you agree that information about you may be provided to:
We require our affiliates, partners, technology developers, and providers to adhere to confidentiality standards which prohibit them from using your data for any purposes other than assisting in your coaching.
In addition, if you are under the age of 18, information may be provided to your parent/guardian as a part of the coaching process.
In cases of suspected abuse or neglect of children or vulnerable adults, and threats to harm yourself or others, that information must be reported to the local police, emergency department, or welfare department. In an emergency, information may be released in accordance with professional practices.
By signing this Agreement, you acknowledge that the data collected during coaching sessions, including, but not limited to feedback, notes and communication, may be stored and processed by Momentum Labs for the purpose of improving your coaching experience. This data will be handled in accordance with applicable privacy laws.
This Agreement is governed by, and is subject to, the terms and conditions set forth in the coaching package you selected. Services will begin upon the signature of this agreement by you and Momentum Labs.
Services: Individual mental skills coaching and supplemental materials (provided by your coach or Momentum Labs) at a frequency you selected through your coaching package.
Coach Selection: You have the ability to select a high performance coach to work with. If you need assistance with coaching selection, please email anthony@momentumlabs.pro. If at any time you would like to change coaches, then you may do so by alerting us at the email listed above.
Teleservice Delivery: Teleservice allows us to provide virtual coaching wherever you are, but it does have limitations, including but not limited to potential technology disruptions, limited visual and audio cues, and unsuitability for clients in needs of additional resources not provided by Momentum. We use Zoom, a HIPAA-compliant platform, with encryption and security measures to protect your data, though rare security failures could risk a privacy breach. If a session is interrupted, we will attempt to reconnect; if unsuccessful after 5 minutes, your Coach will call the number provided at intake unless you specify otherwise. Please note, email is not a secure form of communication. We strongly encourage clients to use the Delenta coaching portal (for which we will provide you access) when applicable.
Payment Responsibility and Billing: By signing this Agreement, you acknowledge that you are responsible for all charges related to the services provided by Momentum Labs. Unless terminated in accordance with the Termination section below, your subscription fee will automatically renew each month. Your monthly subscription fee will be billed monthly based on your coaching package. Once a fee is paid, it is nonrefundable.
Session Cancelation Policy: If you need to cancel an appointment, please email, text or call at least 24 hours in advance. Please note that if an appointment is not used within a calendar month, it is forfeited. There is no option to delay and save a session for the following month.
Termination: Momentum Labs reserves the right to terminate the coaching relationship at any time if it is determined that the Client’s needs are outside the scope of Momentum Lab’s coaching services or if there is a violation of the terms of this Agreement. The Client may also terminate or temporarily pause the coaching relationship at any time by notifying the coach in writing and emailing Momentum Labs at anthony@momentumlabs.pro at least 48 hours prior to the next monthly renewal. Upon termination of this Agreement, no additional fees will be incurred but Client will be responsible for payment for services rendered up to and including the date of termination.
